Lawsuits, one phase at a time
Litigation needs can change as evidence develops. We quote defined phases in writing and explain what each includes. Your agreement identifies the boundaries between phases and the work that needs a further agreement.
Court filing fees, service, transcripts and mediator charges are separate. We identify expected costs in your proposal.
Personal injury
Personal injury attorney's fees are a percentage of the gross recovery: 33 1/3 percent if your claim resolves before a lawsuit is filed, 40 percent if it resolves after a lawsuit is filed, and 45 percent if it resolves after trial begins. Trial begins when jury selection starts or, in a trial before the judge alone, when the first evidence is presented. The fee is calculated on the gross recovery before case expenses are deducted. Appeals require a separate written agreement.
Case expenses, such as filing fees, records, depositions and expert witnesses, are separate from the attorney's fee and are the client's responsibility, including if there is no recovery, unless we agree otherwise in writing. We explain the payment arrangements before you hire us.
We charge no attorney's fee for routine collection of your own PIP or MedPay benefits. Disputed coverage requires a separate scope.
Example only. A claim settles for $30,000 before a lawsuit is filed. The attorney's fee is $10,000. Case expenses of $600 and medical bills of $8,000 are paid from the recovery. You receive $11,400.
You decide whether to accept a settlement offer. We explain the offer, costs and alternatives so you can make an informed decision.
Advance fees and refunds
We hold advance fees in the firm’s trust account until earned. Your agreement explains the milestones at which the firm earns a flat fee. We refund unearned amounts when a representation ends.
